Intel Leads $20M Round For Solera Networks

solera deep seeSolera Networks just announced that it has raised $20 million in Series D funding from Intel Capital (the chip-maker's investment arm) and others. The company says its DeepSee Platform can index and classify all network traffic, giving companies a comprehensive picture of their network security in real-time, either for spotting risks before a security breach or responding quickly once a breach has occurred. Jury finds Afghan family guilty in honor killings (AP)

KINGSTON, Ontario ? A jury on Sunday found an Afghan father, his wife and their son guilty of killing three teenage sisters and a co-wife in what the judge described as "cold-blooded, shameful murders" resulting from a "twisted concept of honor."

The jury took 15 hours to find Mohammad Shafia, 58; his wife Tooba Yahya, 42; and their son Hamed, 21, each guilty of four counts of first-degree murder in a case that shocked and riveted Canadians from coast to coast. First-degree murder carries an automatic life sentence with no chance of parole for 25 years.

After the verdict was read, the three defendants again declared their innocence in the killings of sisters Zainab, 19, Sahar 17, and Geeti, 13, as well as Rona Amir Mohammad, 52, Shafia's childless first wife in a polygamous marriage.

Their bodies were found June 30, 2009, in a car submerged in a canal in Kingston, Ontario, where the family had stopped for the night on their way home to Montreal from Niagara Falls, Ontario.

Prosecutors said the defendants allegedly killed the three teenage sisters because they dishonored the family by defying its disciplinarian rules on dress, dating, socializing and going online. Shafia's first wife was living with him and his second wife. The polygamous relationship, if revealed, could have resulted in their deportation.

The prosecution alleged it was a case of premeditated murder, staged to look like an accident after it was carried out. Prosecutors said the defendants drowned their victims elsewhere on the site, placed their bodies in the car and pushed it into the canal.

Defense lawyers said the deaths were accidental. They said the Nissan car accidentally plunged into the canal after the eldest daughter, Zainab, took it for a joy ride with her sisters and her father's first wife. Hamed said he watched the accident, although he didn't call police from the scene.

After the jury returned the verdicts, Mohammad Shafia, speaking through a translator, said, "We are not criminal, we are not murderer, we didn't commit the murder and this is unjust."

His weeping wife, Tooba, also declared the verdict unjust, saying, "I am not a murderer, and I am a mother, a mother."

Their son, Hamed, speaking in English said, "I did not drown my sisters anywhere."

But Judge Robert Maranger was unmoved, saying the evidence clearly supported their conviction for "the planned and deliberate murder of four members of your family."

"It is difficult to conceive of a more despicable, more heinous crime ... the apparent reason behind these cold-blooded, shameful murders was that the four completely innocent victims offended your completely twisted concept of honor ... that has absolutely no place in any civilized society."

Hamed's lawyer, Patrick McCann, said he was disappointed with the verdict, but said his client will appeal and he believes the other two defendants will as well.

But prosecutor Gerard Laarhuis welcomed the verdict.

"This jury found that four strong, vivacious and freedom-loving women were murdered by their own family in the most troubling of circumstances," Laarhuis said outside court.

"This verdict sends a very clear message about our Canadian values and the core principles in a free and democratic society that all Canadians enjoy and even visitors to Canada enjoy," he said to cheers of approval from onlookers.

The family had left Afghanistan in 1992 and lived in Pakistan, Australia and Dubai before settling in Canada in 2007. Shafia, a wealthy businessman, married Yahya because his first wife could not have children.

The prosecution painted a picture of a household controlled by a domineering Shafia, with Hamed keeping his sisters in line and doling out discipline when his father was away on frequent business trips to Dubai.

The months leading up to the deaths were not happy ones in the Shafia household, according to evidence presented at trial. Zainab, the oldest daughter, was forbidden to attend school for a year because she had a young Pakistani-Canadian boyfriend, and she fled to a shelter, terrified of her father, the court was told.

The prosecution said her parents found condoms in Sahar's room as well as photos of her wearing short skirts and hugging her Christian boyfriend, a relationship she had kept secret. Geeti was becoming almost impossible to control: skipping school, failing classes, being sent home for wearing revealing clothes and stealing, while declaring to authority figures that she wanted to be placed in foster care, according to the prosecution.

Shafia's first wife wrote in a diary that her husband beat her and "made life a torture," while his second wife called her a servant.

The prosecution presented wire taps and cell phone records from the Shafia family in court to support their honor killing theory. The wiretaps, which capture Shafia spewing vitriol about his dead daughters, calling them treacherous and whores and invoking the devil to defecate on their graves, were a focal point of the trial.

"There can be no betrayal, no treachery, no violation more than this," Shafia said on one recording. "Even if they hoist me up onto the gallows ... nothing is more dear to me than my honor."

Defense lawyers argued that at no point in the intercepts do the accused say they drowned the victims.

Shafia's lawyer, Peter Kemp, said after the verdicts that he believes the comments his client made on the wiretaps may have weighed more heavily on the jury's minds than the physical evidence in the case.

"He wasn't convicted for what he did," Kemp said. "He was convicted for what he said."

(AP) ? Hazy fog and heavy smoke from a brush fire clouded a north Florida interstate overnight, leaving drivers blinded and causing wrecks that killed at least nine people, authorities said Sunday.

Photographs taken Sunday morning showed the burned-out shells of at least two vehicles and a tractor-trailer, with gray smoke still rising above the asphalt on an otherwise desolate Interstate 75.

Florida Highway Patrol Lt. Patrick Riordan said the pileups happened around 3:45 a.m. on both sides of I-75 south of Gainesville. All lanes of the interstate ? there are three lanes running each direction ? remained closed as investigators began trying to figure out exactly what caused the wrecks. Vehicles were still smoldering, and firefighters sprayed foam to try to put out the fires.

Cars appeared to have smashed into tractor-trailers and, in one case, a motor home. Some cars were badly crushed beneath the wreckage of the larger rigs.

Riordan said several people were injured and taken to Gainesville hospitals. Their conditions were unclear.

At least 18 people hurt in the wreck were being treated at Shands at the University of Florida, said hospital spokeswoman Allison Wilson.

Donna Henry told The Gainesville Sun that she was driving south on the interstate at 3:45 a.m. when she encountered the smoke.

"We just hit it, and you couldn't see anything," said Henry, who was driving with friends back home to Palm Bay. She said her car struck a guardrail and ended up sideways in the outside lane. She pulled off the highway and called 911. She told the paper that she could hear the other crashes.

"You heard like 15 times somebody hit, from this side and that, north and south. It was bad."

The FHP had briefly closed the highway before the crashes because of a mixture of fog and smoke from a marsh fire in the Paynes Prairie area south of Gainesville. Officers patrolling the highway had reopened the road when visibility improved.

Riordan said he is not sure how much time passed between the reopening of the highway and the first crash.

Riordan said this is the worst accident he's seen in his 27-year career with FHP.

Traffic is being diverted onto U.S. 301 and State Road 27, Riordan said.

Heavy fog and smoke were blamed for another serious crash four years ago. In January 2008, four people were killed and 38 injured in a series of similar crashes on Interstate 4 between Orlando and Tampa, about 125 miles south of Sunday's crash. More than 70 vehicles were involved in those crashes, including one pileup that involved 40 vehicles.

Screen actors get their say in Oscar race (omg!)

Actress Regina King poses next to a placard for nominee Laurence Fishburne at a press preview of the 18th annual Screen Actors Guild Awards showroom in Los Angeles, California January 27, 2012. King is the the social-media ambassador for the SAG Awards and will give viewers a behind-the-scenes look at the awards as she posts on Twitter and Facebook during red carpet arrivals. LOS ANGELES (Reuters) - After months of talking and weeks of voting, Hollywood's actors finally name their picks for the best performances in the films and TV shows of 2011 at the annual Screen Actors Guild Awards on Sunday.

The SAG honors, which are closely watched in the race for Oscars, follow the Golden Globe, Critics' Choice and other awards given by media watchers, as well as acknowledgements from the U.S. Producers Guild and Directors Guild, which represent their respective professional groups in industry matters.

"The Artist," a romantic tale of a fading actor whose career is eclipsed by the woman he loves just as talkies are putting an end to silent pictures, has won top awards from many of those groups including the Directors Guild on Saturday night and will look to do as well with SAG voters on Sunday.

But "Artist" faces stiff competition from civil rights-era drama "The Help," which comes into Sunday night's awards with more nominations, four, more than any other movie, as well as from George Clooney-starring "The Descendants".

The actors in all three of those movies, along with the performers in Woody Allen's "Midnight in Paris" and the ladies of comedy "Bridesmaids," will compete for the night's top honor, best ensemble cast in a film.

The SAG Awards are a key barometer of which films and actors have a good chance at winning Oscars, the world's top film honors given on February 26 by the Academy of Motion Picture Arts and Sciences, because performers make up the largest voting branch of the academy.

In other SAG races, Clooney, playing a father struggling to keep his family together, squares off against Jean Dujardin of "Artist" fame and Brad Pitt for his role as a numbers-crunching baseball executive in "Moneyball." The other two nominees in that category are Demian Bichir in the little seen "A Better Life" and Leonardo DiCaprio for "J. Edgar."

The SAG race for best actress is seen as a tight one among Meryl Streep playing former British Prime Minister Margaret Thatcher in "The Iron Lady," Viola Davis as a maid in "The Help" and Michelle Williams for her turn as Marilyn Monroe in "My Week with Marilyn."

Rounding out that category are Glenn Close in a gender-bending role as a butler in "Albert Nobbs" and Tilda Swinton as a troubled mother in dark drama, "We Need to Talk about Kevin."

SAG also hands out awards for best supporting roles in movies, and it honors performances in TV dramas, comedies and mini-series. But because of SAG's importance in the Oscar race, the film categories are most closely followed.

The SAG Awards air on U.S. TV on Sunday night from Los Angeles on cable networks TNT and TBS.

Secret Service probes bullet-ridden Obama image on Facebook (Reuters)

PHOENIX (Reuters) ? The U.S. Secret Service is investigating the origins of a photo on an Arizona police officer's Facebook page that shows a group of armed youths posing in the desert with what appears to be a bullet-ridden image of President Barack Obama on a T-shirt.

Max Milien, a Secret Service spokesman, said on Friday that the agency was looking into the picture taken of seven youths, four of them toting guns, that turned up on the Facebook page of Sergeant Pat Shearer of the Peoria, Arizona, police department.

"Any time information is brought to our attention where an individual or a group of individuals expresses unusual direction of interest in one of our protectees, we conduct appropriate follow-up," said Milien.

He said individuals have a right of freedom of speech, but "we certainly have the right and duty to speak to individuals to determine what their intent is."

The Peoria police also said they were conducting an internal inquiry into whether the officer's actions violated any department policy. Peoria is a suburb west of Phoenix.

The department was informed of the situation by the Secret Service early on Thursday afternoon, a spokesman said.

The photo, which was shown on local TV with the youths' faces blanked out, has since been removed from Shearer's Facebook page.

In an interview with a local television station, Shearer said the picture was taken by him, and he did not feel it was "that big of a deal." He called it a "political statement."

He told the station he stands by Obama and would give up his life for him.

"It's not like they (the youths) were going to go out and shoot the president," Shearer said.

The 25-year veteran officer has not been placed on administrative leave, Peoria police spokesman Jay Davies said.

He could face a range of disciplinary action if found to be in violation of department's policy governing use of social and electronic media.

That police states: "Employees shall not post, transmit, reproduce, and/or disseminate information (text, pictures, video, audio, etc.) to the Internet or any other forum (public or private) that would tend to discredit or reflect unfavorably upon the department or any of the department's employees."

Davies declined to discuss specific details of the department's investigation.

Danielle Airey, a Peoria Unified School District spokeswoman, confirmed that one of the youths in the picture is a district high school student but did not know about the others.

She declined comment on whether any action has been taken against the student.

"Our first step really is working with authorities as they conduct their investigations," she said.

Newark, NJ, told to produce Facebook pledge log (AP)

NEWARK, N.J. ? The state's largest city must produce a list of documents related to a $100 million pledge to its public schools from Facebook founder Mark Zuckerberg, a judge ruled Friday.

The ruling stemmed from of a lawsuit brought by the American Civil Liberties Union on behalf of a group representing Newark schoolchildren that is seeking more transparency about the donation. The Associated Press and other news outlets also have made such requests.

State Superior Court Judge Rachel Davidson's ruling requires the city to produce the list, believed to enumerate about 50 pages of emails pertaining to the donation, by Feb. 10. The city could seek to block the publishing of some of the emails on the list, according to ACLU New Jersey attorney Ed Barocas.

The city, in a response letter to an AP request for the documents in 2010, said that any conversations between Democratic Mayor Cory Booker and Zuckerberg were "not made in the course of the Mayor's official duties" and therefore were exempt from open-records laws.

Were Booker found to have been acting in his capacity as mayor, the letter continued, the city didn't have the records requested. But it added that if the records were found, their release was barred under executive privilege.

The ACLU, in its lawsuit, argued that privilege can be claimed only by the governor, not by a sitting mayor. It argued that the public has a right to know how the grant funds are to be used and who is making the decisions on their allocation.

"We don't want to make it seem that there was necessarily something nefarious going on," Barocas said Friday. "All we ask is for this to be transparent. The public should be aware what, if any, agreements were made prior to or as part of the grant of the money."

City attorney Anna Pereira declined to comment Friday, citing the ongoing litigation.

In court filings, the city has said that the Facebook grant is being administered not by the city but by two not-for-profits that it doesn't fund, operate or exercise any control over. The city's schools were placed under state control in 1995 after instances of waste and mismanagement, including the spending of taxpayer money by school board members on cars and restaurant meals.

Newark's public school system is the state's largest, with 75 schools and a student population of about 40,000, according to its website. The schools have been plagued for years by low test scores, poor graduation rates and crumbling buildings.

The $100 million pledge to the schools was announced in the fall of 2010 by Booker, Zuckerberg and Republican Gov. Chris Christie as they appeared together on Oprah Winfrey's syndicated talk show.

Zuckerberg described the gift as a "challenge grant" to Booker, who has sought to raise $100 million more to match what Zuckerberg promised to contribute over five years. Zuckerberg's social networking website, based in Palo Alto, Calif., is estimated to be worth more than $50 billion.

Anthony Bourdain's 'The Layover' In Los Angeles (VIDEO)

It was definitely boys' night out on "The Layover" last night. For the season finale, Anthony Bourdain flew into LAX, had the immediate customary In-N-Out meal, and then proceeded to hit up all of LA's restaurant bad boys: Ludo Lefebvre, Roy Choi, Vinny Dotolo and Jon Shook.

Ludo Lefebvre did not disappoint. He tackled the usual East-West beef with some awesome advice for New Yorkers in an extra website segment: "I think New York is a little too fou-fou. You know, I just come back from New York and people need a fart, to poof a little, because they're all so stuffy in New York."

Roy Choi served as guide to Koreatown, where Bourdain got some insight into a Korean restaurant courting ritual. A holdover from an earlier era, women can expect to eat and drink for free at certain restaurants, as long as they agree to chat with men who are paying for their meals. Sounds fun, right? It may be, but not the way one woman described it: "it's kind of like speed dating, except, like, the girls have no agency."

The episode ends at Jumbo's Clown Room, which Bourdain visits with Dotolo and Shook after a debaucherous, foied-out dinner at Animal. As the dudes indulge in some burlesque and beer, Bourdain exclaimed that there was "something remarkably wholesome" about the exotic dancing bar. He also said he would even bring a significant other to Jumbo's, which sounds like another dubious date in the making. Since this is the only segment that doesn't get to live a second life on the Travel Channel's episode guide, here it is again for your viewing pleasure Warning: explicit material:

"I used to talk shit about LA because thats kind of what you're expected to do as a New Yorker," said Bourdain at the beginning of the episode. The truth is, though, that he loves our city -- but not enough to live here, which he was happy to keep repeating throughout the episode.

3 Strong Companies Investing in Themselves

It's no secret that corporations are sitting on huge piles of cash these days. In fact, by the latest count non-financial US companies have over $2 trillion in cash and other liquid assets on their books.

It's understandable that companies are still a little gun-shy in deploying that cash after the Great Recession. But with money market funds and Treasury bills paying paltry returns for the foreseeable future, businesses need to find other places to put all that dough to work.

Ideally, a company should use its capital to maximize long-term value for their shareholders. But unfortunately some managers understand this better than others. Many corporate executives are more concerned about empire-building than producing high returns on capital and often make reckless decisions with shareholders' money.

Decisions, Decisions

There are plenty of uses for a company's excess cash to try and generate strong returns for shareholders. They could plow it back into the business to fund growth, acquire other companies, or distribute it to shareholders through dividends.

Or the company could invest in itself; that is, buy back shares.

Investing in Themselves

When a company announces a stock buyback, it's a powerful signal to investors that management is confident in the long-term outlook of the company and that the share price is fundamentally undervalued.

And when the company actually buys back its shares, it has a direct benefit in that it reduces the number of shares outstanding. This means that earnings are divided among fewer shares. In other words, your piece of the pie just got bigger.

Use Caution

Stock buybacks don't always add value, however. If a company commences a share repurchase and shares go down in value, clearly it's not a good use of shareholders' cash. The money would have been better allocated elsewhere to generate returns for shareholders.

So make sure you look at the underlying business before investing in a company, because all the buybacks in the world won't save a company headed off a cliff.

3 Financially Solid Companies Buying Back Stock

I've highlighted 3 companies below who have been buying back significant amounts of their shares outstanding. And because each one has a strong cash balance and no long-term debt, they're well-positioned to continue buying back stock in the future:

Bed Bath & Beyond (BBBY)

Cash & Securities to Total Assets: 26%
Long-term Debt to Total Assets: 0%

Bed Bath & Beyond is a home furnishings retailer with over 1,000 stores in the United States and Canada.

Since December 2004, Bed Bath & Beyond has spent $3.7 billion buying back its stock, including $859 million through the first 9 months of 2011. And total shares outstanding has decreased by 13% since 2007. That's one way to grow EPS.

Insperity (NSP)

Cash & Securities to Total Assets: 42%
Long-term Debt to Total Assets: 0%

Insperity is a leading Professional Employment Organization (PEO) that provides a wide array of Human Resource solutions to small and mid sized firms.

The company's sizeable cash position and zero debt has allowed it to buy back shares of its common stock. In the third quarter of 2011 alone, the company bought back over 668,000 shares of stock (~3% of shares outstanding). As of September 30, 2011, it was authorized to repurchase an additional 1,352,089 shares under its share repurchase program.

Accenture plc (ACN)

Cash & Securities to Total Assets: 33%
Long-term Debt to Total Assets: 0%

Accenture provides consulting and technology services to clients around the globe. With very little fixed assets and capital expenditure requirements, the company is able to return a substantial portion of its cash flow to shareholders through stock buybacks and dividends.

On top of paying a dividend that yields 2.4%, the company has been aggressively buying back its shares outstanding. From fiscal 2007 through fiscal 2011, the company generated $13.6 billion in free cash flow. It spent a whopping $12.5 billion of that buying back its stock.

And in its latest 10-Q, the company stated that it "intend[s] to continue to use a significant portion of cash generated from operations for share repurchases during the remainder of fiscal 2012."

The Bottom Line

With the economy improving and cash representing the highest percentage of total assets since 1959, it's time companies start putting that money to good use to generate decent returns for shareholders. One way is to invest in itself and buy back its shares.

That is, of course, if the company is worth investing in.

Todd Bunton is the Growth & Income Stock Strategist for Zacks.com and Co-Editor with Steve Reitmeister of the Reitmeister Value Investor that snaps up discounted value stocks and sells them after the market realizes their true worth for long-term gains.

Europe to issue tough new data-protection rules soon (Reuters)

MUNICH/PARIS (Reuters) ? The European Union will propose tough new rules in the coming days on how corporations handle Internet users' personal data, a long-awaited move that could have far-reaching implications for Web giants such as Google Inc and Facebook.

Viviane Reding, vice president of the European Commission, said in a speech on Sunday that the new data-protection legislation was needed to protect users and cut red tape for businesses in Europe.

"Only if consumers trust that their data is protected will they entrust companies with it ... We need individuals to be in control of their information," Reding said at the DLD conference of tech industry leaders in Munich.

But Reding also emphasized a need to simplify Europe's approach to online data protection, arguing that the current system was too cumbersome and costly for business.

"In Europe we have too many rules, conflicting rules," she said. "The extra cost to business of this fragmentation is 2.3 billion euros ($3 billion) a year."

Europe's new data-protection rules are expected to be issued on January 25.

The EU regulation will need to be approved by national governments, some of which, such as France and Germany, may resist seeing their oversight on privacy matters shift to Brussels.

The legislative process is likely to take at least two years, so the rules could still change considerably. Internet companies will not be required to comply before 2014 or 2015.

The new rules come amid widespread change in how people use the Internet. Social networks such as Facebook and LinkedIn have attracted nearly a billion users, while so-called cloud computing services, which allow businesses and people to stock data on distant servers and access it anywhere, are going mainstream.

The questions of who owns such data, to what end companies can use it and for how long remain major issues of debate among Internet firms, governments and consumers.

Facebook, the world's largest social network, has been investigated by U.S. and European regulators for its treatment of user data and privacy policies. In November, it signed a settlement with the U.S. Federal Trade Commission that will subject it to 20 years of independent audits, and it recently signed an accord with Ireland's privacy regulator on how it treats international users' data.

There has also been a series of high-profile breaches such as one at Sony Corp's online videogame network last year in which hackers stole the data of some 77 million users.

NEW POWERS

According to a draft obtained by Reuters, the EU proposals would bolster significantly regulators' powers on fighting data-protection breaches, requiring companies to notify regulators when data has been stolen or mishandled.

The proposals also give member states new powers to fine companies up to 1 percent of their global revenues for violating EU data rules. The Financial Times reported in December that the rules would allow for fines up to 5 percent of global revenues, so the EU may have reconsidered its approach since then.

The proposals grant broad, new rights to individuals, including a so-called "right to be forgotten" that would allow people to request that their information be erased and not disseminated online.

The rules also create a "right to data portability" to ensure that people can easily transfer their personal information between different companies or services.

Such rules could force social networks to change the way they handle users' data.

In written comments submitted to the EU last year, Facebook expressed concerns that the EU's approach in some areas was too proscriptive for the fast-changing world of the Internet and urged caution on proposals for stiffer sanctions.

"There is a risk that an excessively litigious environment would impede the development of innovative services that can bring real benefit to European citizens," the company wrote.

Participants at the DLD conference were also divided about coming EU changes.

Stefan Gross-Selbeck, CEO of Germany's professional social network Xing, said his company was still subject to harsher rules than its U.S. counterparts.

"I appreciate the EU commitment to create a level playing field in Europe ... But the regulation that Facebook's founder Mark Zuckerberg is subject to is nothing compared to what I'm subject to."

Chris Poole, founder of the online community 4chan that is a haven for hackers, welcomed the prospect of even tougher enforcement on companies that mishandle users' data.

"I would love to see some regulation that would hold Sony responsible," he said, referring to the PlayStation data breach last year. "They deserve to be punished." ($1 = 0.7740 euros)

Julian Assange says he's launching TV talk show (AP)

LONDON ? You've read his leaks. Now watch his show.

Cyber-transparency activist Julian Assange says he's launching a career in television, hosting what he's billing as a new brand of talk show built around the theme of "the world tomorrow."

The show's guests haven't been disclosed, but Assange has promised to give viewers more of what he's been supplying for years: Controversy.

The WikiLeaks secret-spilling site said in a statement released late Monday that "iconoclasts, visionaries and power insiders" would be brought in so that Assange could challenge them on their vision of world affairs and "their ideas on how to secure a brighter future."

The world of television talk shows is a new one for the 40-year-old Australian, whose group has orchestrated the biggest mass-disclosures of secret documents in U.S. history. But the statement argued that Assange was uniquely qualified for the role given his past as "a pioneer for a more just world and a victim of political repression."

Ellis Cashmore, an expert on celebrity culture at England's Staffordshire University, wasn't so sure.

"Assange has got a good, deep voice and agreeable Aussie accent, but he's a slow, deliberate talker and not especially televisual," Cashmore said in an email. "To be true to his image, he would have to make his proposed show subversive; and that might not appeal to many would-be guests."

WikiLeaks said that the show would begin airing in mid-March, although how the show will be produced and who will carry it are open questions.

It's not even clear Assange will be free to host the show. He's currently fighting extradition to Sweden, where he's wanted over sex crimes allegations, and U.S. officials are still weighing possible charges linked to his attention-grabbing leaks.

In its statement WikiLeaks referred queries about the series to the hitherto obscure Quick Roll Productions, whose website carried no indication of where the group was based or who was managing it. An online records search indicated that Quick Roll's site was created about two weeks ago.

Neither Quick Roll nor WikiLeaks returned emails seeking further details on their project.

US beats Venezuela 1-0 on Clark's late goal

Jermaine Jones, Jose Velasquez

By BOB BAUM

updated 12:49 a.m. ET Jan. 22, 2012

GLENDALE, Ariz. - Ricardo Clark had barely played in the last six months. His last appearance for his German second-division team came in July, and this was his first game for the U.S. national squad since August.

Finally given a chance, he provided the goal that had eluded his team all night.

Clark headed Jermaine Jones' corner kick into the net in the 7th minute of stoppage time and the United States beat Venezuela 1-0 in a friendly on Saturday night.

U.S. coach Jurgen Klinsmann inserted Clark into the game in the 86th minute.

"Ricardo came in and you could see that he was struggling because he hasn't played for many months," Klinsmann said. "He was trying hard to catch up with the group and still not there because of that long stretch. But once on the field he is a player that is technically very gifted."

The U.S. had dominated play with nothing to show for it before Clark beat goalkeeper Jose Morales from 7 yards away for his third international goal and first since September 2009.

Venezuela was livid at the finish, upset with a series of calls and non-calls by officials that led to a series of events concluding with the winning goal.

Moments after Clark scored, Venezuela's Jose Velasquez was ejected with a red card. Venezuela drew four yellow cards to one for the United States.

"For us, it was sad to give up a goal in the 98th minute," Venezuela coach Cesar Farias said. "For us, this result leaves a sour taste and the way we lost, but the experience is important."

The first match between the countries in five years featured the "B" teams of both nations because the top players are with their professional squads.

An exception was Jones, who is playing with the national team while serving an eight-game suspension by the German soccer federation.

"It was a great cross," Clark said of the corner kick that led to the goal. "I found a good spot and made the most of it."

It was Clark's first game since the United States played Mexico on Aug. 10. He last scored in international competition against Trinidad and Tobago on Sept. 9, 2009.

The 28-year-old midfielder from Jonesboro, Ga., is ignominiously remembered for a play in the 2010 World Cup, when Ghana's Kevin-Prince Boateng stripped the ball from him and put the Black Stars ahead in the fifth minute. Ghana went on to eliminate the Americans 2-1 in overtime.

Jones, who served as U.S. captain for the game, was suspended when the German federation concluded he had intentionally stepped on the foot of star player Marco Reus during a break in the action of a German Cup game between Jones' team Schalke and Borussia Moenchengladbach.

The U.S. outshot Venezuela 15-6, many of the opportunities from short range, but the shots were errant, or Morales made one of his five saves.

Even though it was a struggle, Klinsmann liked what he saw from his young players.

"We had 10, 12 chances and they had no chances, we controlled completely and that gives them confidence," he said. "We wanted to give them a feeling of this type of game that they can play with these nations."

Morales was shaken up after he took a knee to the left thigh from American C.J. Sapong. The goalkeeper sat on the ground for several minutes until the decision was made to leave him in the game, an incident that led to the extended stopping time that featured the winning goal.

The United States beat a team from South America for the first time since a 3-1 win over Ecuador on March 25, 2007. The U.S. had 10 losses and three ties against teams from that continent since then.

The U.S .improved to 3-4-1 since former German World Cup star Klinsmann took over from Bob Bradley as coach last year.

Jones had one of the best chances for a goal but missed from point-blank range. The U.S. had also failed miserably on set plays until the game winner.

Venezuela had a scoring shot in the 62nd minute but Carlos Salazar's header went right into the hands of goalkeeper Bill Hamid. Moments later, the U.S. squad missed another chance when Teal Bunbury's shot off a breakaway was just right of the post.

Venezuela and the United States played for the fourth time. The U.S. leads the series 2-0-1.

Clark's goal was only the sixth for the U.S. teams in Klinsmann's eight games as coach.

Clark, a former player with Major League Soccer's Houston Dynamo, is with Eintracht Frankfurt but has fallen out of favor and hasn't been in a match for the team since July 25, the second game of the season.

The United States plays Panama in Panama City on Wednesday.

Hamid made his U.S. national team debut along with defender A.J. DeLaGarza, midfielder Graham Zusi and substitute Sapong.

Complication in first triple limb transplant (AP)

ANKARA, Turkey ? A Turkish doctor whose 25-member team performed the world's first triple limb transplant ? two arms and a leg ? says the leg has been removed due to tissue incompatibility.

Dr. Omer Ozkan says 34-year-old Atilla Kavdir is in stable condition after the removal of the leg on Sunday, a day after it was attached. Kavdir lost his arms and right leg when he was 11 after he hit power lines outside his home with an iron rod to scare away pigeons and received an electric shock.

Ozkan said another patient who received a full face transplant from the same donor is in stable condition. It was Turkey's first face transplant.

TiVo updates HD user interface, adds multi-room streaming (Digital Trends)

mini_guide1

Announced on the official TiVo blog earlier this week, the DVR service company is rolling out a new user interface for owners of the?TiVo Premiere, TiVo Premiere XL, and TiVo Premiere Elite. Called?version 20.2, the new update overhauls the previously translucent high definition grid guide and live guide as well as?introduces a mini-guide, info banners, speed improvements, a revision to the discover bar, improvements to the search algorythm and the ability to stream content between TiVo boxes on the same home network. Multi-room streaming is a popular trend that?s been introduced by a handful of media companies over the past year.

grid_guide4Prior to the update, the TiVo Premiere?user interface used a see-through background on top of the main picture. The new high definition interface isolates the channel feed to the top right corner of the screen and covers the remainder of the screen with a dark blue background. The user also has the option of turning the video feed completely off. In addition, the TiVo design team has added an updated icon to designate new episodes and added the?first aired date to the description of the episode so the user can tell if the episode is from the most recent season. There?s also a new option to sort by channel name if the user prefers to find a station like ?ABC? or ?FOX? by name rather than hunt down the channel number.

TiVo is also launching a mini-guide that allows the user to continue watching the episode on the full screen, but creates a small overlay at the bottom of the screen which includes three channels at a time. Just like the full guide, users can change the channel, select programs to record and cycle through hours in advance. When the user wants more information about the program, new info banners at the bottom of the screen have been implemented rather than taking the user to a full information page. The banners allow the user to continue watching the television episode and include new data such as the upcoming show in the next time slot as well as the amount of data that the TiVo has recorded if the user wants to rewind to a specific spot.

infobanner_full_info

Changes to the discovery bar have decreased the amount of the content on the bar to four selections, assuming the user has left the video feed in the top right corner turned on. Content on the bar has also been labeled with reasons why the television shows and movies have been selected.?Categorization?includes popular Season Pass content, highly rated content, popular Web content, new on-demand content or recently recorded shows. ?When the user highlights the content in the discovery bar, there?s a more complete description why that content was chosen. TiVo?s update to the search bar includes the ability to search through Hulu Plus content as well as search by channel name. The ability to search through content on Netflix, Amazon Prime and Blockbuster was already available in prior updates.

multi_room_streamingPrior to this update, users had to transfer a movie or television show between two different TiVo boxes to watch the content in another room. With multi-room streaming, the user can browse content on another TiVo box on the same network and simply select ?Play? to activate streaming. Once the user completes the television show or movie, they can also delete the content off the remote box. However, TiVo?recommends?that users attempting to stream high definition content should use a wired connection instead of streaming over Wi-Fi.

This update has already been released for many TiVo Premiere?owners, but is expected to hit all boxes by the end of January 2012. The update is automatically downloaded to the TiVo?Premiere hardware and installed during the early hours of the morning to avoid the heaviest viewing traffic. Users that pay for TiVo?Premiere through cable companies will have to wait to the Spring for the full update. Also dated for the Spring, TiVo is planning to roll out updated Netflix and YouTube applications, parental controls within the HD menus and?Xfinity-on-Demand from Comcast?in specific, unannounced?geographical markets.?

Kardashian Magazine, Barbie Deals Fall Apart

Mother Kris Jenner's demands for editorial control reportedly kill family's deal with American Media Inc.

Is the Kardashian brand in a deep dekline? It seems that several of the family's in-the-works projects are no longer in the works.

The New York Post is reporting that Kris Jenner's demands have killed a deal that would have seen publishers American Media Inc., the company behind The National Enquirer and Star, creating a Kardashian-themed magazine.

Sources say that mama Jenner tried to play hardball with the publishers, demanding that she get full editorial approval when it comes to Kardashian-related content in any and all of the magazines the company publishes.

"AMI chief David Pecker made it clear that there was no way he was going to tell his editors what stories they could and couldn't do," a source explained, adding that the company "balked" at her stipulation. Perhaps in response, Star magazine recently published a cover story claiming that the late Robert Kardashian is not Khloe's biological father.

Speaking to MTV News, a source close to the negotiations took no issue with the accuracy of the story, hinting that the deal is indeed dead in the water. A rep for the family told the Post, "Kris has never had a conversation with AMI regarding this issue [of her demands]. But the allegations contained in the Star article about Khloe not being a Kardashian are completely fabricated, false and untrue. Robert Kardashian is absolutely her biological father, so of course she was upset over their story."

It's not the only blow the Kardashian brand is being dealt. According to previous reports, the ladies had been in talks with Mattel to work on their own Kardashian-themed Barbie dolls. It seems, however, that those plans have also been shelved.

A rep for Mattel told MTV News, "As popular as the Kardashian sisters are, at this point in time we are not manufacturing Barbie-branded Kardashian dolls."

Major oil refinery to close in US Virgin Islands (AP)

ST. CROIX, U.S. Virgin Islands ? One of the world's largest oil refineries will close next month, the company announced Wednesday, stunning nearly 2,000 workers and threatening to upend the reeling economy of the U.S. Virgin Islands.

Industry analysts said the closure is unlikely to have a major effect on the global oil market, but Gov. John de Jongh described the loss of the territory's largest private employer as "a complete body blow" for the U.S. territory of about 108,000 people.

He said Hovensa generated a minimum of $60 million a year in revenue for the government, which recently laid of hundreds of public workers due to a budget crisis.

"Given what we're going through right now, this is the last bit of news that I wanted to hear," he said in a teleconference with reporters.

Losses at Hovensa, a joint venture of U.S.-based Hess Corp. and Venezuela's state-owned oil company, have totaled $1.3 billion over the past three years and were projected to continue due to reduced demand caused by the global economic slowdown and increased refining capacity in emerging markets, said Brian K. Lever, president and chief operating officer of Hovensa LLC.

"We deeply regret the closure of the Hovensa refinery and the impact on our dedicated people," Lever said in a statement. "We explored all available options to avoid this outcome, but severe financial losses left us with no other choice."

Hess announced in New York that it will take a $525 million after-tax charge against its fourth-quarter 2011 earnings due to the shutdown.

The refinery employs about 1,200 people in St. Croix in addition to approximately 950 contractors, according to Hovensa spokesman David Roznowski. About 100 people, including contractors, will work at the oil storage terminal, the company said.

The refinery, founded in the 1960s, has been producing about 350,000 barrels per day during the rough economic climate. It relies on oil for fuel while competitors on the U.S. mainland use less expensive natural gas.

Hovensa was the third largest U.S. refinery before it cuts its capacity of 500,000 barrels by 30 percent last year. It is now the eighth largest, according to the U.S. Energy Information Administration.

The refinery dominates the southern coast of St. Croix, where hundreds of workers live in company-built neighborhoods.

Speaking in hushed tones during a shift change at Hovensa on Wednesday, dozens of workers wondered where they would go after the refinery is converted to an oil storage terminal.

"This is all I know," said a worker who had been with the plant for more than 30 years. "I don't know what I am going to do now."

Like others, he declined to be identified for fear of angering managers who will allocate the few remaining jobs.

The company's website says it is still one of the 10 largest oil refineries in the world, but the closure is not expected to have a major effect on the oil industry because it had not been operating at full capacity, said Fadel Gheit, senior energy analyst for Oppenheimer & Co.

Hess benefits because it had been hemorrhaging money through the refinery, he said.

The closure reflects a three-year trend across the U.S. of refineries closing because of the global financial crisis, a drop in gasoline consumption and a shift in growth elsewhere, Gheit said.

"They cannot compete with the modern refineries being built in India, China and the Middle East," he said.

Despite the closure, the U.S. remains Venezuela's largest customer, and Venezuela is still among the top four suppliers of crude oil to the U.S., he said.

Alejandra Leon, a Latin America oil analyst for Cambridge, Massachusetts-based IHS CERA, said that in 2010, PDVSA reported the Hovensa refinery processed 389,000 barrels a day, of which 227,000 barrels a day were supplied by Venezuela. She said it wasn't clear where the remainder came from.

She said there is an excess of refining capacity globally, so Hovensa's closure "is helping to rebalance the market."

Hovensa spokesman Alex Moorehead said the refinery equipment will shut down by mid-February, but that the company will continue to provide fuel oil to the island's Water and Power Authority through end of June.

Local Sen. Terrence Nelson said the announcement "is a blow in the gut," and suggested the territory might need assistance from the federal government.

Nelson accused Hovensa of violating a long-term agreement with the government to continue refinery operations on the island. Nelson said it is unclear what Hovensa will need to do to compensate the government for breaching the agreement.

"It's devastating," Senator Sammuel Sanes said. "It was something I suspected was going to happen, but of course it took me by surprise. On a personal level it affects many people in my family. I have many in my family working for Hovensa."

De Jongh said he called an emergency meeting to talk about ways to offset the economic damage.

He warned that local fuel prices will likely rise while the government looks for other suppliers and said officials are asking the U.S. Environmental Protection Agency to ease sulfur content restrictions so they can quickly contract a new supplier. The Energy Information Administration reported last year that the refinery accounted for 85 percent of the territory's petroleum products.

De Jongh said he will also ask Hovensa officials if they are interested in selling the facility.

"I cannot afford to have an asset of that size sitting there," he said.

In January, Hovensa entered into a consent decree with the U.S. Environmental Protection Agency and Justice Department in which the company agreed to invest $700 million on pollution controls after a series of chemical releases affected people living downwind from the refinery. Hovensa also agreed to pay a $5.4 million penalty for violating the Clean Air Act.

It is unclear how the agreement will be affected by the closure.

EPA spokeswoman Mary Mears said the agency and the U.S. Department of Justice are still talking with Hovensa officials about how the closure will affect the consent decree. She said the company already paid the penalty.

Obama rebuts Romney's foreign policy criticism (AP)

WASHINGTON ? President Barack Obama says Republican presidential front-runner Mitt Romney and his rivals are "playing to their base" in attacking his foreign policy record.

Obama tells Time magazine that they'll keep doing so until the primary season is over. But the president contends that overall it will be hard to argue that he hasn't executed a strategy that's put the country in a stronger position.

Responding to a question in the Time interview, Obama invokes Romney by name ? something he rarely does ? referring to "Mr. Romney and the rest of the Republican field" in saying they were playing to their base but that their attacks won't withstand what he calls "serious debate."

Obama also dismisses GOP claims that he has a policy of appeasement or apologizes for America.
