Top senators question Pentagon move on fighter jet

(AP) ? The leaders of the Senate Armed Services Committee suggested on Monday that Defense Secretary Leon Panetta rushed a decision to develop the Marine Corps version of the next-generation strike fighter jet despite new technical problems with the troubled program.

In a letter to the Pentagon chief, Sens. Carl Levin, the committee chairman, and John McCain, the panel's top Republican, questioned whether the F-35B had met the criteria to warrant an end to its probation. Last January, then Defense Secretary Robert Gates had put the Marines' version of the aircraft on a two-year probation because of "significant testing problems."

Panetta ended the probation late last month.

Levin, D-Mich., and McCain, R-Ariz., wrote that the program "has enjoyed some success over the last few months, after several years of having fallen short." But they said "more problems with the F-35B's structure and propulsion, potentially as serious as those that were originally identified a year ago, have been found. This is salient where the F-35B has completed only 20 percent of its developmental test plan to date. Your decision, therefore, appears at least premature."

The two senators sent a list of 14 questions about the program's development and the advice Panetta received before making his decision.

In announcing his decision last month, Panetta said the military was committed to developing the aircraft ? which can take off from shorter runways and land vertically ? but that the program was "not out of the woods yet."

The F-35 is the Pentagon's most expensive weapons program, and it has been troubled by schedule delays and cost overruns. Ten years in, the total F-35 program cost has jumped from $233 billion to an estimated $385 billion. Recent estimates suggest the entire program could exceed $1 trillion over 50 years.

The developer of the aircraft, Lockheed Martin Aeronautics Co., is building three versions of the F-35 ? one each for the Navy, Air Force and Marine Corps. The plane would replace Cold War-era aircraft such as the Air Force F-16 fighter and the Navy's F/A-18 Hornet.

In outlining next year's defense budget, Panetta said the administration would slow the purchase of the F-35, a step Congress would have to approve.

In their letter, Levin and McCain expressed frustration with the Pentagon's consultation with the committee about the aircraft and complained that they learned of Panetta's decision on ending probation from media reports.

Children among seven dead as quake hits Philippines (Reuters)

MANILA (Reuters) ? A magnitude 6.7 earthquake off the central Philippine island of Negros killed at least seven people on Monday, including two children, with government offices and schools ordered to close after at least 40 aftershocks.

A grade-six pupil died after being plucked out from a collapsed chapel wall while a nine-year-old girl was killed when the concrete wall of a school collapsed, officials said.

A three-storey building caved in and some seaside cottages were destroyed by waves in La Libertad, Negros Oriental, near the epicenter of the quake 5 km (three miles) off the shore of Tayasan town and at a depth of 10 km, according to local calculations.

The U.S. Geological Survey had measured the quake at magnitude 6.7 and at a depth of 12.4 miles.

The volcanology and seismology institute lifted a tsunami alert. Some roads, bridges and houses sustained cracks, but major roads remained passable.

"While the threat of immediate danger appears to have passed, we urge the people in affected areas to remain watchful and calm, and to cooperate with the authorities," a presidential spokesman said.

Television footage showed people scurrying out of buildings, residents converging in open spaces and frightened school children in tears.

"I have advised our people to return to their homes and stay calm. I appeal to our president for help. We're just recovering from Typhoon Sendong and now this earthquake," Negros Oriental Governor Roel Degamo said in a television interview, referring to a typhoon which killed about 1,250 people in the southern Philippines in December.

The quake was felt in areas within a radius of about 70 miles.

Over the weekend, the USGS also recorded a magnitude 5.6 quake off the shore of Samar province also in central Philippines and situated northwest of Negros.

The Philippines lies on the Pacific "Ring of Fire" and is prone to earthquakes and volcanic eruptions. A 7.8 magnitude quake in 1990 in the northern Philippines killed more than 1,600 people.

Homeless killings suspect faces new murder charges (AP)

SANTA ANA, Calif. ? A former Marine already accused of killing four homeless men was charged Monday with two new counts of murder in the stabbing deaths of his high school friend's mother and older brother.

Itzcoatl Ocampo, 23, was charged in the killing of 53-year-old Raquel Estrada and her son, 34-year-old Juan Herrera, in the family's rented home on a quiet Yorba Linda cul-de-sac in October.

Charges were dropped against Estrada's son Eder Herrera, a former schoolmate of Ocampo, who was freed after more than three months in jail.

Orange County District Attorney Tony Rackauckas said authorities found DNA evidence linking Ocampo to the murders of Estrada and Juan Herrera on an item of clothing found during a search of his family's home last month, when Ocampo was charged with the homeless murders.

"The homeless people killed were all easy victims but he clearly wasn't limited to that," Rackauckas told reporters. "He's just a monstrous serial killer."

The slender, bearded Ocampo appeared briefly in court Monday in an orange jail jumpsuit and agreed to postpone his arraignment until March 16. He will also be arraigned on charges of murdering four homeless men in a killing spree in December and January in the county known as the home of Disneyland.

The killings led police to fan out and urge people to seek shelter indoors.

Ocampo's attorney Randall Longwith said the new murder charges didn't fit with the previous allegations against his client, who was mainly concerned on Monday with being allowed to visit with his family. His younger brother and sister sobbed after seeing him shackled in a caged area of the courtroom.

"I'm shocked as to these charges," said Longwith, who declined to comment on the details until he had reviewed the evidence.

Estrada and her son were stabbed to death in their home in October, and Herrera, 24, was arrested shortly afterward. Police found large amounts of blood smeared inside the house and a black ski mask, black hat, wallet and sunglasses on the kitchen table, according to a copy of the search warrant affidavit.

Police seized numerous items from the home, including multiple cell phones and a notebook containing sorrowful writings from Herrera's room, court papers showed.

Authorities deemed Herrera's behavior suspicious that night because he was driving around with a friend but did not want to stop and check on his family when police swarmed the small street after the murders, prosecutors said. In addition, authorities said a video surveillance tape from a drug store near the spot where a 911 call was made from a pay phone, reporting loud noises coming from the home, showed a person who resembled Herrera and wore similar-looking shoes.

Rackauckas said Herrera is still considered to be suspicious, but the newly discovered DNA evidence changed the way authorities viewed the case and they no longer felt they had sufficient evidence to detain him.

Herrera's attorney Huy Nguyen declined to comment on the details of the case, citing the ongoing investigation. He declined to say whether his client was cooperating with investigators.

Herrera, a Mexican citizen, also faces a hearing in immigration court to determine if he can remain in the country after telling immigration officials he came here illegally.

Herrera and Ocampo both attended Esperanza High School and graduated in 2006. The two were friends and Herrera spent two weeks at the Ocampo family home several years ago, Ocampo's relatives said.

Herrera's brother Juan was found stabbed more than 60 times, and his body was left in a hallway in the home the family rented last February. His mother was stabbed more than 30 times, authorities said.

Each of the four homeless men was stabbed more than 40 times with a weapon believed to be a 7-inch, fixed-blade, military-type knife, authorities said.

Victim James Patrick McGillivray, 53, was stabbed Dec. 20 near a shopping center in Placentia; Lloyd Middaugh, 42, was found Dec. 28 near a riverbed trail in Anaheim; Paulus Smit, 57, was stabbed to death outside a Yorba Linda library on Dec. 30; and John Berry, 64, was stabbed to death on Jan. 13 outside a fast-food restaurant.

Ocampo was arrested later that night with blood on his forearms outside a nearby mobile home park after a witness who saw the attack on Berry helped chase him down, according to an affidavit filed by police to search Ocampo's home. At Ocampo's house, officers seized multiple items of clothing, a knife sharpener, a medical marijuana letter and a LIFE magazine titled "The Most Notorious Crimes," court papers showed.

Ocampo is charged with six counts of murder and special circumstances allegations for multiple murders, lying in wait and use of a weapon.

Are new unemployment figures a boost for Obama?

Unemployment in the US has fallen to 8.3 percent, the lowest level since February 2009. It looks like good news for President Obama, but Republicans aren't buying it. And there are other political and economic trends that should give the White House pause.

Friday?s good news on the economy ? an unemployment rate that dropped to 8.3 percent in January as the economy added 243,000 jobs ? might have caused the White House staff to do cartwheels. If you?re going to get blamed when things are rough, why not celebrate when they go well?

But that would have been behind closed doors, and the official response was more measured.

?These numbers will go up and down in the coming months, and there's still far too many Americans who need a job or need a job that pays better than the one they have now,? President Obama said. ?But the economy is growing stronger.?

Came the quick retort from Mitt Romney, front-runner in the GOP race to try and unseat Obama: ?Not so fast, Mr. President. This is the 36th straight month with unemployment above the red line your own administration drew. The real unemployment rate is over 15 percent. Mr. President, America has also had enough of your kind of help.?

(Romney?s ?real unemployment rate over 15 percent? apparently includes the underemployed and those who?ve gotten discouraged and stopped looking.)

So the political question is: How much can Obama be credited with what looks to be an economic turnaround ? if indeed that?s what we?re seeing?

On ABC?s ?This Week? Sunday, Larry Summers, Obama's former economic adviser who served as Treasury Secretary in the Clinton administration, put a positive spin on the new employment figures.

?Unlike many of the favorable past reports, if you look beneath the surface of this one, almost every indicator within it is favorable,? he said. ?The growth is mostly from the private sector. The alternative survey, the household survey, suggested 500,000 or more jobs were created. The revisions of past months were favorable. People are working a longer week. Paychecks are going up. The number of vacancies, firms looking for work, are going up.?

Blogging in the New Yorker, John Cassidy points out that if January?s rate of hiring continues, within a few months the jobless rate will drop below 7.8 per cent ? where it stood when Obama took office.

?At that point, it will be tough for Mitt Romney to stand up and say the President?s policies have made the recession worse,? Cassidy writes. ?And it will be impossible for Republicans to deny that things are getting better.?

Republican congressional leaders don?t deny that the employment situation is improving. They just think it would be better if they were in charge ? or at least if Obama would urge Senate Majority Leader Harry Reid to take up the jobs bills that have passed in the House with bipartisan support.

Political prognosticators say the improving employment news gave a bump to Obama?s standing in the 2012 presidential race.

The Intrade prediction market now gives him a 57 percent chance of being re-elected. Romney has a 38 percent chance of preventing that, according to Intrade.

?While a month of 250,000 jobs added isn?t sufficient to get the president re-elected, it was?necessary,? writes Sean Trende at Real Clear Politics. "We should realize that this isn?t exactly the 1.1 million jobs added in September 1983, but it is absolutely an important first step for Obama to get back into the 2012 race.?

Still, in a mock election Obama leads Romney by a scant 2.2 percent in the Real Clear Politics average of recent polls.

And in an article titled ?Why Obama should be worried,? Jim Vandehei at Politico warns against ?Pollyanna punditry.?

?There are a bunch of real-time numbers coming in that tell a much different tale,? he writes.

?There?s a new?Congressional Budget Office report?that shows unemployment likely to climb to nearly 9 percent by the election, there?s polling data showing Obama tied or trailing Mitt Romney in the most?important swing states?(and doing only marginally better against Ron Paul), and there is mounting evidence that the assumption of a decisive Obama fundraising advantage for the fall might be flat wrong,? Vandehei writes.

Over at Gallup, the polling organization reports that in just ten states and the District of Columbia do a majority of those surveyed approve of the job Obama is doing, according to monthly tracking data through 2011.

So if the White House gained a little spring in its step from the latest job figures, it needs to focus on other trends as well.

Popular character actor Ben Gazzara dies in NY (AP)

NEW YORK ? Ben Gazzara, whose powerful dramatic performances brought an intensity to a variety of roles and made him a memorable presence in such iconic productions over the decades as the original "Cat on a Hot Tin Roof" on Broadway and the film "The Big Lebowski," has died at age 81.

Longtime family friend Suzanne Mados said Gazzara died Friday in Manhattan. Mados, who owned the Wyndham Hotel, where celebrities such as Peter Falk and Martin Sheen stayed, said he died after being placed in hospice care for cancer. She and her husband helped marry Gazzara and his wife, German-born Elke Krivat, at their hotel.

Gazzara was a proponent of method acting, in which the performer attempts to take on the thoughts and emotions of the character he's playing, and it helped him achieve stardom early in his career with two stirring Broadway performances.

In 1955, he originated the role of Brick Pollitt, the disturbed alcoholic son and failed football star in "Cat on a Hot Tin Roof." He left the show after only seven months to take on an equally challenging role, Johnny Pope, the drug addict in "A Hatful of Rain." It earned him his first of three Tony Award nominations.

In 1965, he moved on to TV stardom in "Run for Your Life," a drama about a workaholic lawyer who, diagnosed with a terminal illness, quits his job and embarks on a globe-trotting attempt to squeeze a lifetime of adventures into the one or two years he has left. He was twice nominated for Emmys during the show's three-year run.

Gazzara made his movie debut in 1957 in "The Strange One," Calder Willingham's bitter drama about brutality at a Southern military school. He had previously played the lead role of the psychopathic cadet, Jocko de Paris, on Broadway in Willingham's stage version of the story, "End of Man."

He followed that film with "Anatomy of a Murder," in which he played a man on trial for murdering a tavern keeper who had been accused of raping his wife.

After "Run for Your Life" ended in 1968, Gazzara spent the rest of his career alternating between movies and the stage, although rarely with the critical acclaim he had enjoyed during his early years.

In the 1970s, he teamed with his friend director John Cassavetes for three films, "The Killing of a Chinese Bookie" and "Opening Night." In another Cassavetes film, he appeared with Falk, and the two became friends (it was Cassavetes who introduced them to the Wyndham Hotel, according to a 1982 article in New York magazine).

Gena Rowlands appeared with Gazzara in "Opening Night," which also starred Cassavetes. Cassavetes and Rowlands were married; he died in 1989. Falk died last year.

"It breaks my heart to have this era come to an end. Ben meant so much to all of us. To our families. To John. To Peter. To have them gone now is devastating to me," she said in a statement.

She said her prayers and thoughts went out to "all his loyal and wonderful fans throughout the world."

Rita Moreno, who played Gazzara's wife in the 2000 film "Blue Moon," said, "He was a wonderful man, and I so enjoyed working with him. I wish I could have had the pleasure more often."

Other Gazzara films included "The Bridge at Remagen," "The Young Doctors," "They All Laughed," "The Thomas Crown Affair," "If It's Tuesday, It Must Be Belgium," "The Spanish Prisoner," "Stag" and "Road House." He also made several films in Italy.

He appeared on Broadway in revivals of "Who's Afraid of Virginia Woolf?," "Awake and Sing!" "Strange Interlude" and several other plays.

Gazzara began acting in television in 1952 with roles on the series "Danger" and "Kraft Television Theater." Before landing "Run for Your Life," he played a police detective in the series "Arrest and Trial," which lasted two seasons.

Born Biagio Anthony Gazzara in New York on Aug. 28, 1930, he grew up on the Lower East Side of Manhattan in a cold-water flat with a bathtub in the kitchen. His parents were immigrants from Sicily who met and married in New York, and his first language was Italian. Although he was baptized under his birth name, his parents always called him Ben or Benny.

As a child he became fascinated with movies, and after giving his first performance, in a Boys Club play, he knew he had found his life's work.

"I disliked high school," he once said, "and after two years of it I left without telling anyone at home."

Instead he spent his days in movie theaters.

He entered Erwin Piscator's Dramatic Workshop in 1948. Eighteen months later he auditioned for the Actors Studio run by Lee Strasberg and was accepted.

The school was a beehive of activity in those days, turning out such followers of method acting as Marlon Brando, Montgomery Clift, James Dean, Barbara Bel Geddes, Shelley Winters, Paul Newman, Joanne Woodward, Rod Steiger and Julie Harris.

"There's a lot of voodoo about the Actors Studio," Gazzara told The Associated Press in 1966. "In the best sense it was a place for professionals to stay in touch with their craft, where newcomers and professionals mingled, to grow, to try parts they would never get in the professional theater and to even fall on their face."

Gazzara's first two marriages, to actresses Louise Erikson and Janice Rule, ended in divorce.

While filming "Inchon" in Korea in 1981, he met Krivat. They married the following year, and the union endured.

"Elke saved my life," Gazzara said in 1999. "When I met her, I was drinking too much, fooling around too much, killing myself. She put romance and hope back in my life."

He adopted Krivat's daughter, Danja, as his own. She recalled on Friday that he was a "complex soul" and that his role as a father to her and his own daughter was challenging.

"I adored Ben, and so did his daughter," she said. "But we both had difficulty with him ... I think the difficulty lay in his complexity of being an actor and those layers that you have, that you bring with you."

Besides Danja, Gazzara is survived by his wife, daughter Elizabeth and a brother.
